
Structural litigation have gained prominence in the Brazilian and international legal landscape as a crucial tool for dealing with complex and multifaceted problems. This paper explores the potential of these processes in both public and private sectors, discussing their capacity to promote sectoral reforms and address systemic challenges. To this end, the distinctive characteristics of structural problems are analyzed. Furthermore, with the aim of maximizing the effectiveness of these processes, the interface between the creation of incentive structures and the promotion of significant behavioral changes is examined. Finally, the role of behavioral incentives in shaping structural plans and their connection with the functionalization of civil liability in this context is discussed.
