
This study is a dogmatic analysis of on-demand work through digital platforms. The choice of the topic is justified by the search for implementing decent work as the eighth sustainable development goal of the 2030 Agenda, in addition to the great legal uncertainty resulting from the new form of work organization in the context of a digital economy. This research uses a qualitative analysis methodology, employing hypothetical-deductive approaches of a descriptive and analytical nature, adopting the technique of bibliographic and documentary research, with consultation of legislation, doctrine and case law, aiming to explain the legal contours of the employment relationship of motorists and delivery people who provide passenger transportation and delivery services through digital platforms, in order to assess the existence or not of an employment relationship.
